On September 15, 2010 the ADA 2010 Standards were signed into law. The deadline for compliance with the 2010 Standards is March 15, 2012.
ATMs fall under the Auxiliary Aids and Services portion of the Standard; the effective communication standard requires speech enabling on ATMs in order to remove barriers for the vision impaired. Initially the law was not clear as to the required compliance date for existing ATMs; however as the Department of Justice continues to educate their staff we have been told that all ATMs must be in compliance by March 15, 2012, unless doing so would cause an undue burden.
Over the next few months we will continue to post information regarding compliance with the ADA 2010 Standards on our Website @ www.wellingtonatm.com. As soon as possible we will communicate directly with you regarding the pricing for retro-fitting your ATM. At that time we will request that you inform us which direction you wish to go. There will be options to upgrade your ATM now, at sometime in the future prior to the March 15, 2012 deadline, possibly trade in your current ATM for a new compliant ATM or you may chose to go beyond the deadline, claiming it would cause your business an undue burden. The Department of Justice stated they will take each case separately in determining undue burden.
